There are three laws that businesses must comply with regarding the proper disposal of sanitary waste:
Workplace (Health, Safety, and Welfare) Regulations 1992: This regulation specifies that all businesses must provide appropriate means for sanitary product disposal in every women's washroom.
Water Industries Act 1991: This act states that items that can cause blockages or buildup in sewer or drainage systems should not be flushed down the toilet. Since tampons and pads are non-dissolvable, flushing them can result in drain blockages. Failure to provide sanitary bins or suitable disposal methods often leads to flushing of these products, thereby violating the law governing the bathroom environment.
Environmental Protection Act 1990: The "duty of care" policy outlined in this act places the responsibility on businesses to correctly collect, store, and dispose of waste produced on their premises, including sanitary waste. Employees should not be burdened with managing this waste. Therefore, some means of collection and storage, such as a bin, must be provided.
These three laws unequivocally demonstrate that all businesses must have some form of bin in any toilet used by women. Employers who fail to provide a sanitary disposal method are simultaneously violating three sanitary waste disposal laws, making them susceptible to significant legal fines.
Considering that some transgender men and non-binary individuals menstruate, it is also essential to have a bin in male-gendered bathrooms to accommodate the needs of clients and employees and comply with the law.
Another common query companies have regarding the sanitary bin requirement is when a standard bathroom bin is sufficient, when it is necessary to hire a specialised contractor, and whether feminine hygiene waste is hazardous.
